The 28 yr old male that was arrested In regards to this investigation has now been charged with Assault and Breach of Probation.

He was released from custody and will appear in Sydney Provincial Court on November 16^th 2010.

On Friday August 27, 2010 at approximately 7:10 pm, members from the Cape Breton Regional Police Service responded to Butt Street in Sydney Mines because of a report of an assault. The victim an 84 yr old male was travelling along Butt Street when his car stalled. He pulled into a parking lot to check his vehicle and while looking under the hood an unknown male came up from behind and assaulted him.

Two persons who were nearby called 911 to report this incident. EHS paramedics responded to this location and treated this male for non life threatening injuries. A K-9 unit was called to this location and was able to locate clothing the suspect was wearing along with a knife. Police were unable to locate this suspect. At approx 10:30 pm members arrest a 28 yr old suspect in regards to this incident. He is presently in lock-up and will be held for investigators who will interview him later today. Investigation is ongoing.
